These Terms of Use (“Terms”) govern your use of www.tclegacyholdings.com (the “Site”), operated by TC Legacy Holdings LLC (“TC Legacy,” “we,” “us”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. What the Site is for
The Site provides general information about rental homes owned by TC Legacy. It also links to services for booking showings, applying, and accessing the Resident Portal. Nothing on the Site is an offer to lease, a guarantee that a home is available, or legal, financial, or other professional advice.
2. Listings, pricing, and photos
- Listings are provided through RentEngine and update automatically. Availability, rent, deposits, fees, features, and pet policies can change at any time without notice, and may contain errors. The signed lease controls.
- Photos on our home page and other general pages are illustrative images and do not show a specific property. Photos within individual listings show the actual home being offered.
- Please confirm any details that matter to you with us before applying or signing a lease.
3. Showings and applications
Booking a showing or submitting an application does not guarantee approval or a lease. Applications are reviewed under our rental criteria and applicable law, including fair housing and consumer reporting laws. Showings, applications, and the Resident Portal are provided by third-party services (RentEngine and DoorLoop), and their own terms also apply.
4. Fair housing
TC Legacy is an Equal Housing Opportunity provider. We do not discriminate on the basis of race, color, religion, sex, national origin, ancestry, familial status, disability (including blindness), or any other characteristic protected by federal, West Virginia, or local law. 5. Text messaging terms
By texting us or giving us your mobile number, you agree to receive text messages from TC Legacy about your inquiry, showings, application, lease, or residency. Consent is not a condition of renting. Message frequency varies, and message and data rates may apply. Reply STOP to opt out, or HELP for help, or call (304) 898-8006. Carriers are not liable for delayed or undelivered messages. 6. Acceptable use
You agree not to:
- Use the Site for anything unlawful or fraudulent, including scams involving our properties
- Interfere with the Site’s security or operation, or try to gain unauthorized access
- Scrape, copy, or republish our listings or content for commercial purposes without our written permission
- Misrepresent yourself or anyone else
7. Intellectual property
The Site’s content, including text, design, logos, and the TC Legacy Holdings name, belongs to TC Legacy or its licensors and is protected by law. You may view and print pages for your personal, non-commercial use.
8. Third-party services and links
The Site embeds and links to services we do not control, including RentEngine, DoorLoop, and Google. We are not responsible for their content, availability, or practices, and your use of them is governed by their terms.
9. Disclaimer of warranties
THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, TC LEGACY AND ITS MEMBERS, MANAGERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR OPPORTUNITY, ARISING FROM YOUR USE OF THE SITE. This section does not limit any rights you have under a lease or under laws that cannot be waived.
11. Indemnification
You agree to indemnify and hold harmless TC Legacy from claims, losses, and expenses, including reasonable attorneys’ fees, arising from your misuse of the Site or your violation of these Terms.
12. Governing law
These Terms are governed by the laws of the State of West Virginia, without regard to its conflict-of-law rules. Any dispute about the Site will be brought in the state or federal courts located in West Virginia, and you consent to their jurisdiction.
13. Changes
We may update these Terms at any time. The “Last updated” date shows the latest version. If you keep using the Site after changes are posted, you accept the updated Terms.
